1. With the assistance of Official Assignee, I have perused the report dated 14th June 2023 and have heard the learned counsel for the petitioning creditor on the said report.

2. For the reasons set out in the said report, I am inclined to grant the reliefs in terms of prayer clauses (a) to (c) of the said report.

3. The Petitioning Creditor is hereby directed to deposit the sum of Rs.50,000/- with the Official Assignee 1/2 11-oar-1-2023.doc Nikita

towards the Valuation Fees. AT & TS Associates, Valuer from the Panel of the high Court is hereby appointed as Valuer in the said matter for valuation of property of subject matter and submit the valuation report.

4. The said report is made absolute with regard to the order dated 17th February 2023, the insolvent has not been arrested, pursuant to the said order. In view thereof, the Sheriff's Office to include the non-bailable warrant in the name of Mr. Rajesh Shah, and the order dated 17th February 2023 be complied with.
