By this review petition, petitioner seeks recall of the order passed by the learned designate of the Hon'ble Chief Justice in application filed under section 11 of the Arbitration and Conciliation Act, 1996. 2.
Mr.Sen, learned senior counsel appearing for the respondent raises a preliminary objection about maintainability of this review petition and placed reliance on judgment of this court in case of Madhav Structural Engineering Ltd., Mumbai vs. Maharashtra State Road Development Corporation Ltd., Mumbai 2013(2) Mah.L.J. 372 which in my view applies to the facts of this case. In my view the review petition is accordingly not maintainable and is accordingly dismissed as not maintainable.
