TESTAMENTARY AND INTESTATE JURISDICTION CHAMBER SUMMONS NO. 97 OF 2016 IN TESTAMENTARY SUIT NO. 30 OF 2016 IN TESTAMENTARY PETITION NO. 1747 OF 2015 Manoj Manilal Gala ...Plaintiff

Versus

Veljibai Premji Gala ...Defendant Mr. N.C. Parekh, with Mr. Nirav J. Marjadi, i/b Mansukhlal Hiralal & Co., for the Plaintiff.

Mr. Kunal Parikh, i/b Thakore Jariwala & Associates, for the Defendant.

CORAM: G.S. PATEL, J DATED:

1st August 2016 PC:- 1.

The Chamber Summons seeks direction in the Suit under Rule 404 of the High Court (Original Side) Rules. In my view, this is a Rule that should be deleted forthwith. These directions ought to be passed in the ordinary course as soon as the Caveat is taken on file. The Suit is being taken up immediately, by consent, for framing issues and further directions.

The Chamber Summons is disposed of in these terms with no order as to costs.
