By this petition the petitioner seeks appointment of an arbitrator since the sole arbitrator has expressed his inability to continue and has resigned. Both parties today are agreeable to appointment of a new arbitrator in his place. Both counsel state that an arbitrator from the panel of arbitrator maintained in this Court may be appointed.

In the circumstances, Mr Salil Shah, Advocate is appointed as arbitrator. Parties to appear before the arbitrator on 5 th September, 2018. The arbitral Tribunal will issue appropriate directions. It is made clear that no fresh pleadings will be required to be filed and the arbitration shall proceed from the stage at which the arbitrator had resigned.

Petition is disposed of in the above terms.
