904(ii)-CUAPP.38.2017.doc IN THE HIGH COURT OF JUDICATURE AT BOMBAY ORDINARY ORIGINAL CIVIL JURISDICTION CUSTOMS APPEAL NO. 38 OF 2017 The Commissioner of Customs (ii) } Appellant versus Aramex India Pvt. Ltd.

} Respondent Mr. Swapnil Bangur with Ms. Ruju Thakkar for the appellant.

Mr. Mayank Jain i/b. M/s. Khaitan and Co. for the respondent.

CORAM :- S. C. DHARMADHIKARI & SMT. BHARATI H. DANGRE, JJ.

DATE :- FEBRUARY 8, 2018 P.C. :- 1.

The Revenue essentially questions the maintainability of the first respondent's appeal to the tribunal. The tribunal, relying upon the order passed in the case of M/s. Bombino Express Private Limited (respondent no. 1 in Customs Appeal No. 81 of 2016), did not uphold the objection of the Revenue, but rejected it. The order of rejection of the identical objection to the maintainability of the appeal by the Revenue in the case of M/s. Bombino Express Private Limited has been upheld by us. For identical reasons, we do not find any merit in this appeal of the Revenue. It is, therefore dismissed, but without any order as to costs.
