By this Motion, petitioner has prayed for recalling the order dated 9th January, 2017 passed by this Court in Testamentary Petition No. 1613 of 2015, thereby, restoring the Petition to its original position after condoning delay of 119 days in taking out the Motion.

Mr. Palsuldedesai states that most of office objections are removed by the petitioner and remaining office objections will be removed within two weeks after restoration of the Petition.

In view of the assurance and for the reasons set out in Affidavit in support, order dated 9th January, 2017 passed in Testamentary Petition No. 1613 of 2015 is recalled and the said Petition is restored to its original position. Delay of 119 days in filing the Motion is condoned. The petitioner shall remove office objections within two weeks from today. Motion is disposed of accordingly.
