Not on board. Taken on board.
The only substantive prayer in this petition is for issuing a writ of mandamus directing the Mumbai Municipal Corporation to issue a separate property tax bill for the petitioners'
flats. The petitioners have sought a writ of mandamus. The law is very well settled. Unless the petitioners call upon the concerned Authority to perform its statutory obligations, a petition seeking a writ of mandamus wil not be normally entertained. This law has been laid down in the case of Saraswati
oswpl1787 Industrial Syndicate Limited and others vs Union of India1.
Hence, we decline to entertain this petition. Writ petition is disposed of with liberty to the petitioners to make appropriate representation to the concerned Authority.
