Mr. Malviya seeks leave of the Court to withdraw the petition with liberty to file a fresh petition because various events have transpired after the petition was filed which would require extensive amendment to the petition. The counsels for respondents state that if the Court is inclined to grant the liberty, then all their rights and contentions including on maintainability of the fresh petition should be kept open. The counsels for respondents are justified in making this statement. Therefore, petition dismissed as withdrawn with the liberty as prayed for.
