The Defendant has been ordered to be wound up and Official Liquidator, High Court, Bombay is appointed as a liquidator of the Defendant. Learned Counsel submits that the Plaintiff shall prosecute their claim before the Official Liquidator by submitting a proof of debt. A proof of debt in this behalf is already been submitted to the Official Liquidator. Suit dismissed as withdrawn. The Plaintiff to seek recovery Pg 1 of 2

In view of the disposal of the suit, nothing survives in the Summons for Judgment and the Notice of Motion and the same are disposed of.
