By consent, the Leave Petition is made absolute in terms of prayer clause (a).

On 29th November 2013, there was an order passed by Mr. Justice S.J. Kathawalla in terms of minutes tendered, taken on record and marked "X" for identification. By consent, it is directed that the Suit itself will stand disposed of in terms of clauses (3), (4) and (5) of those minutes.

The Plaintiffs will pay the costs, charges and expenses of the Court Receiver within a period of four weeks from today. 4.

The Suit is disposed of in these terms. Refund of court fee, if any, in accordance with the Rules.

Drawn up decree dispensed with. However, if for the purpose of implementation of these Minutes of Order, should the parties require a drawn up decree, they will be entitled to apply to the Department for one without having to make a separate application in that behalf and on production of an authenticated copy of this order. Drawn up decree is to be strictly in accordance with these Minutes of Order only.

All previous notices issued to either of the party stand discharged.
