Heard Learned Counsel for the parties.

The main grievance of the petitioner in the

2/3 present petition is that, respondent no.3 failed and neglected to comply with the order dated 17th July, 2017 passed under Section 79(2)(a) of the Maharashtra Cooperative Societies Act, 1960 (Exhibit-R page 88 of the petition).

The Learned AGP appearing on behalf of the respondent makes a statement that, he has received instructions in writing from respondent no.3 that he will comply with the order dated 17th July, 2017 within three months from today. To that effect, he has given in writing. The same is taken on record and marked 'X' for identification. The same is accepted.

In view of the statement and undertaking given by the respondent-State, nothing survives in the present Writ Petition. Hence, (a) the Writ Petition stands disposed off as

3/3 having become infructous.

(b) No order as to costs.

(c) In respect of remaining prayers, petitioner is permitted to take out appropriate proceedings and that will be decided on its own merits.
