Ms.Kamath, appearing for the plaintiff states that they have served the notice of motion and the plaint upon defendant no.1 and the newly added defendant no.2 and states that they have filed affidavit of service of one Nilesh Ganesh Sonawane, affirmed on 24th November 2016. From the affidavit it appears that both the defendants have been served on 21st November 2016. No affidavit reply is filed opposing the notice of motion. Therefore, the order passed on 5th July 2016 read with the order dated 28th July 2016 is confirmed as order in the notice of motion. The notice of motion accordingly disposed.
