The Chamber Summons seeks to delete name of the partner of the firm on the basis that the partner has expired. However, the petition is seen to have been filed on behalf of the firm. Learned counsel for the petitioner further states that the partnership firm continues to exist and does not stand dissolved by virtue of demise of Mr. K. N. Shaikh. The Affidavit in support also records the fact that two other partners are continuing business of the firm. In the circumstances, since firm name has not undergone any change, in my view there is no question of permitting deletion of permitting any amendment. Chamber Summons is dismissed. (A.K. MENON, J.)
