In pursuance of the order passed by this Court 16 January 2018, the Respondent has deposited a sum of Rs.1 Crore in this Court. Learned Arbitrator may now call for a preliminary meeting in accordance with the order dated 16 January 2018. Learned Counsel for the Plaintiff, accordingly, seeks leave to withdraw the commercial suit. Commercial Suit is dismissed as withdrawn. All rights and contentions of the parties on merits are kept open, to be agitated before the learned Arbitrator. In view of the disposal of the suit, Chamber Summons (L) No.187 of 2017 does not survive and the same is also disposed of. (S.C. GUPTE, J.)
