Learned Counsel for the Applicant - original Petitioner in the company petition prays for recall of a dismissal order dated 2 August 2013 passed by the Prothonotary & Senior Master of this Court under Rule 986 of the High Court Original Side Rules. Learned Counsel prays that the order be set aside and the petition be restored and thereafter the Petitioner be permitted to withdraw the petition as settled out of court. The company application is made absolute in terms of prayer clauses (a) and (b). The order of dismissal is recalled and the petition is dismissed as withdrawn. There shall be no order as to costs.
