Heard the learned counsel for the petitioners and the learned counsel for respondent Nos.2 and 3. Perused the affidavit of Shri Dilip Santosh Ahire filed on behalf of the Mumbai Municipal Corporation which is dated 12th June 2014. In paragraph 4 of the affidavit, a statement on oath has been made that the petitioners are declared as eligible for allotment of alternate accommodation in the project of 60 feet wide Development Plan Road. In view of the statement as aforesaid, the learned counsel for the Mumbai Municipal Corporation states that the allotment of premises will be made to the petitioners and that the petitioners will be placed in possession within a period of two weeks from

oswpl2152 today. We accept the said statement. She further states that till the date on the petitioners are placed in possession of the allotted premises, the petitioners shall not be evicted from the present premises being Stall No.26. We accept the aforesaid statements.

In view of these statements, nothing survives in the petition and the same is disposed of. The Chamber Summons (L) No.383 of 2013 is also disposed of.
