Heard the learned counsel for the petitioner and the learned counsel for respondent Nos.2 and 3. Perused the affidavit of Shri Dilip Santosh Ahire filed on behalf of the Mumbai Municipal Corporation which is dated 12th June 2014. In paragraph 4 of the affidavit, a statement on oath has been made that the petitioner is declared as eligible for allotment of alternate accommodation in the project of 60 feet wide Development Plan Road. In view of the statement as aforesaid, the learned counsel for the Mumbai Municipal Corporation states that the allotment of premises will be made to the petitioner and that the petitioner will be placed in possession within a period of two weeks from today. We accept

oswpl2153 the said statement. She further states that till the date on the petitioner is placed in possession of the allotted premises, the petitioner shall not be evicted from the present premises being Stall No.27. We accept the aforesaid statements.

In view of these statements, nothing survives in the petition and the same is disposed of. Pending Chamber Summons and Notice of Motion are also disposed of.
