The Company Application seeks condonation of delay in filing the particulars with ROC in pursuance of an order sanctioning the scheme passed in Company Scheme Petition. A case for condonation of delay and extension of time in filing the requisite particulars, is made out in the affidavit in support of the application. Application is, accordingly, allowed in terms of prayer clause (a) of the application. The applicant to file a fresh form INC-28 with the Registrar of Companies within a period of four weeks from today. Both parties to act on the authenticated copy of this order.
