The proprietor of the Defendants is present. He submits to a decree in terms of prayer clauses (a), (b), (c) and (e). In view thereof, Mr Kamod does not press the prayer in damages. 2.
In view of this, the Petition under Clause XIV of the Letters Patent is made absolute.

The seized goods will be destroyed by the Defendants within three weeks from today in the presence of the Plaintiffs representatives. An Affidavit of Compliance is, therefore, not required.

The Court Receiver will stand discharged upon destruction of seized goods but without passing accounts and on payment of his costs, charges and expenses within two weeks thereafter by the Plaintiffs.

The Advocates for the Defendants stand discharged. 6.
The Interim Application will not survive after the destruction of goods and is disposed of accordingly.

Court fees are to be refunded in accordance with the Rules. For the purposes of Section 43 of the Maharashtra Court Fees Act and the proviso to that Section, today's date is the date of making a claim for repayment. The Prothonotary & Senior Master will issue a certificate for a refund of Court Fees computed according to the Rules. He will act on production of an authenticated copy of this order without requiring a separate application. 8.
