The Respondent/State has filed affidavit in compliance of the Order passed by this Court on 9th March 2018. Having gone through the said affidavit and the documents annexed i.e. letter dated 31st March 2018 at Exhibit R-1 and the Notification dated 3rd April 2018 at Exhibit R-2, it is clear that the State has notified the amendment in Rule 3(b)(i) after existing Rule 3(b) of Bombay High Court Appellate Side Service Rules 2000.
In view of the aforesaid, in our considered view, nothing survives with this petition and, therefore, the Petition is disposed of. Gaikwad RD 1/2
(2)WP(O)No .17122016 However with the liberty to the petitioners to seek revival of this petition in case the Respondent/State fails to comply the provisions of the said amended Rule in its correct perspective.
