This is an application for recall and retransfer of papers and proceedings in Company Petition No. 1077 of 2015 from the National Company Law Tribunal (NCLT), Mumbai Bench to this Court. Learned counsel for the applicant submitted that the notice of acceptance was served upon the respondent prior to 15.12.2016 and therefore the proceedings were erroneously transferred to NCLT, Mumbai Bench. The learned counsel for the respondent concedes to the said fact. 2.

In view of the above and in view of the facts mentioned in the affidavit-in-support of the application, the above application is allowed in terms of prayer clauses (a) and (b).
