Heard Mr Sameer Logade, learned Counsel for the Petitioner. By this Petition, Petitioner has sought permission to open locker No.427 standing in the name of Gracie Minino Louis (hereinafter referred to as 'deceased') with Indian Overseas Bank, Branch Bandra, Radhasoami Apartments, TPS-III, 36th Road, Bandra (W), Mumbai-50, in presence of Officer in charge of the said bank, Officer of this Court, Petitioner and Counsel for the Petitioner and authorised valuer, who will value the contents therein and kept the articles in the said locker.

Mr. Logade submits that Petitioner has filed Petition No.2053 of 2016 for Letters of Administration to the property and credits of the deceased. In Schedule-I, Item No.2(a), has disclosed as asset in Locker No.427 standing in the name of the deceased. The deceased died leaving behind her two sisters and one brother as her only heirs and next kin. The deceased died spinster. The Petitioner had to make an inventory as to the said locker. As per the operating instructions locker was to be operated by the deceased. He, therefore, submits that permission may be granted to open the locker in presence of the Officer in charge of the bank, Officer of this Court, Petitioner and Counsel for the Petitioner and authorised valuer. Mr. S.V. Jadhav, Associate of this Court is appointed as Officer of this Court to ensure compliance.
