After the matter is heard at some length, it is agreed between the parties that the Summons for Judgment may be disposed of in terms of the following order. It is, accordingly, ordered as follows : (i) The Defendant shall pay a sum of Rs.90 lacs in full and final settlement of the Plaintiff's claim in the suit in 24 equal monthly installments of Rs.3.75 lacs each. The first of such installment shall be paid on or before 10 March 2018 and the following installments

SJ 97-16.doc shall be paid on every 10th day of the succeeding months; (ii) On payment of the entire amount of Rs.90 lacs, the Plaintiff shall withdraw its appeal, being Appeal No.212 of 2016; (iii) In default of any two installments, the entire decretal amount claimed by the Plaintiff in accordance with the statement of claim annexed as Exhibit 'S' to the plaint, shall be due and payable under this decree.

The Suit stands decreed in the above terms and the Summons for Judgment is disposed of.
