Heard Mr. Dubey, learned Counsel for the applicant. 2.

By this Motion, applicant has prayed for recalling order dated 9th January, 2017 passed in Testamentary Petition No. 1509 of 2015. By order dated 9th January, 2017, petitioner was directed to remove office objections on or before 27th February, 2017, failing which Petition will stand dismissed.

Mr. Dubey states that petitioner has removed most of the office objections and office objections which are not removed are serving of citation and other minor objections. He assures that

30-NMT-186-2017 after restoring the Petition, he will remove office objections within 8 weeks.

In view thereof and for the reasons set out in the affidavit in support of Motion, Motion is made absolute in terms of prayer clauses (a), (b) and (c). Petition No. 1509 of 2015 is restored to its original position. Petitioner shall remove office objections within 8 weeks from today. Order accordingly. [R.G. KETKAR, J.]
