By consent and joint request of the counsel for petitioner and respondents, Mr. Rajiv Narula, an Advocate practicing in this Court, having his office at Aban House, 5th Floor, Sai Baba Marg, Kala Ghoda, Fort, Mumbai - 400 023 (Contact No.66356901/9820325575, is appointed as Arbitrator in place of the earlier Arbitrator Mr. Astad Randeria, to decide the disputes between the parties arising out of the Development Agreement and Power of Attorney both dated 18th March, 2010. Statement of Mr. Narula, who happens to be in Court, that there are no circumstances that would disqualify him to be an Arbitrator or to doubt his independence and impartialities, is accepted. The parties shall appear before the learned Arbitrator in his chambers on 23rd September, 2017 at 11 a.m. and obtain necessary directions.

2/2 27.ARBP-473-2017.doc Mr. Astad Randeria is directed to hand over all the papers and proceedings to the Advocate for petitioner within one week of receiving a copy of this order, which petitioner's Advocates will forward to Mr. Randeria.

The counsel for petitioner and respondents state that if there are outstanding invoices towards fees and out of pocket expenses, they shall, within one week from today, settle the same. All contentions of the parties are kept open. The cost of the Arbitrator initially shall be borne by the parties equally and the same will be subject to orders of the learned Arbitrator. The venue of the arbitration shall be Mumbai.

Petition accordingly stands disposed.
