The motion seeks annulment of the adjudication order passed against the insolvent under Section 21(1) of the Presidency Two Insolvency Act 1909 on the ground of full payment. The Petitioning Creditor confirms full payment. The Official Assignee also has no objection to annulment. The notice of motion is made absolute in terms of prayer clause (a). The Official Assignee shall deduct 3 % commission on the basis of the aggregate liabilities discharged on behalf of the Insolvent and refund the balance to the Insolvent.
