The Suit having been disposed in terms of the Consent Terms dated 19 th December 2019, parties have now sought modification of the terms to the extent that the matrimonial home being occupied by the plaintiff no.2 is now proposed to be transferred to the plaintiff no.1. Plaintiff no.2 has since agreed to vacate the flat and both the plaintiffs have agreed that an application will be made to the landlords for transferring the tenancy in favour of plaintiff no.1. The parties have agreed upon certain commercial terms, as set out in Schedule of Amendment. An order is now sought to modify the decree in terms of the amended terms singed by the parties and their Advocates. 1/2 16-IA-2149-2021.doc Dixit

Both the plaintiffs are present. They confirm having agreed to the modified terms. They confirm having signed the Schedule of Amendment. Accordingly, I pass the following order :- (i) By consent, the consent terms dated 19 th December 2019 shall stand amended to the extent provided in the Schedule of Amendment annexed in the IA.

(ii) IA is allowed in terms of prayer clauses (a) and (b). (iii) Draft decree shall be lodged within four weeks from today.

(iv) IA is disposed in the above terms.
