The Petition is for leave under Clause XII of the Letters Patent. The proposed Suit is for damages and loss caused to the Plaintiff as well as claim of amounts paid towards advance payments by the Plaintiff to Defendants. The contractual terms appeared to have been arrived at over exchange of emails and discussions at the Plaintiff's office based at Mumbai. The advance payments had been made by the Plaintiff to Defendant from the Plaintiff's bank account based in Mumbai. However, the Defendants reside in Andhra Pradesh. The Defendants had also filed caveat before this Court. I am satisfied that, a material part of the cause of action having arisen within the jurisdiction of this 1/2
