This Chamber Summons seeks that a delay of 13 days in filing the Affidavit in Support of the Caveat be condoned.

For the reasons set out in the Affidavit in Support, the Chamber Summons is made absolute in terms of prayer clause (a). Affidavit in Support of the Caveat has already been filed and served.

Mr. Dhumatkar seeks costs. He is certainly entitled to do so. Just how much, if anything, is for the Court to decide. Mr. Singh for the Caveators promptly agrees to pay costs, quantified at Rs.13/-. He says he will do so by account payee cheque. This is noted. 4.

The Petition is to be forthwith renumbered as a Suit and to be placed for framing issues on 27th October 2015. (G. S. PATEL, J.)
