By an order dated 28 March, 2016 after hearing the parties I had passed certain directions inter alia directing the Respondent Company to deposit a sum of Rs.5 Lacs in this Court and granting liberty to the Petitioner herein to file a suit to recover his dues. I am informed that the amount of Rs.5 Lacs has been deposited in this Court on 21 April, 2016 and thereafter the Petitioner has filed a Special Civil Suit No.639 of 2016 in the Joint Civil Judge, Senior Division Court at Pune. Therefore, a joint request is made today that the Prothonotary and Senior Master of this Court be directed to transfer the deposit of Rs.5 Lacs to the credit of the Special Civil Suit No.639 of 2016.

4.cp.615.2014.doc In view of the fact that the aforesaid suit has already been filed in Joint Civil Judge, Senior Division Court Pune, the Prothonotary and Senior Master of this Court is directed to transfer Rs.5 Lacs to the credit of Special Civil Suit No.639 of 2016 which is pending in the Joint Civil Judge, Senior Division Court, Pune. The Company Petition is disposed of accordingly. There shall be no order as to costs.
