The order impugned in the Petition is an order passed by DRT. Inasmuch as the Petitioner has a remedy of Appeal before DRAT, we are not inclined to entertain the Petition. We dismiss the Petition with liberty to the Petitioner to approach DRAT.

We record the statement of the learned Counsel for the Respondent - Bank that for a period of 3 weeks, the 1/2

DRAT may pass orders as it deems appropriate without being influenced by the orders passed by this Court. The sum of Rs.50 lacs deposited by the Petitioner with the Respondent Bank under order dated 29/06/2015 of this Court shall however be considered by DRAT in the waiver application, if any, filed by the Petitioner. The pendency of the present Petition before this Court shall be taken into account by DRAT in condoning the delay in filing the Appeal before DRAT. (M.S.KARNIK, J.) (A.A.SAYED, J.) 2/2
