The counsel for the plaintiff states that this is a suit for possession under Section 6 of the Specific Relief Act, 1963. The counsel seeks leave of the Court to withdraw the suit with liberty to present the same before the Small Causes Court.

The suit allowed to be withdrawn with liberty as sought. The registry Shraddha Talekar PA 1/2

1.s.742.2013.doc of the Small Causes Court to place the matter before the appropriate Court on 2nd March 2015.

Needless to say that the rights and contentions of the defendants are kept open and they are permitted to file the written statement, if not already filed.

Liberty to apply to the Small Causes Court for interim orders also granted. With the suit, all the interim applications pending also stand transferred to the Small Causes Court.
