The Foreign Adoption Petition is in respect of a female minor, Vaishnavi, born on 20th December 2015. The Sarkarwada Police Station, Nashik took charge of her. Her parents could not be traced. She was produced before the Child Welfare Committee. She was given in a safe custody of the Petitioner institution, Adharashtram by an order of the CWC dated 20th June 2017.

She has since been declared legally free for adoption following the necessary procedures. The undertaking /Affidavit of the Petitioner is on record. CARA has subsequently granted its no objection to the adoption.

The adoptive parents are from Malta. They are 47 and 46 years old. They have been married for 15 years but have no children of their own.

The health report of the minor suggests that she has Beta Thalassaemia. The adoptive parents have countersigned the reports and the additional tests reports. The health reports of the adoptive parents are in order. Their HIV reports are tendered by Mr Kapoor in a separate compilation, taken on record and marked "X" for identification.

The adoptive father works as a Manager with the Dairy since 2016 with an annual salary of Euro 35,000. The adoptive mother is a self-employed freelance tourists guide and earns about Euro 8,221. The tax returns and other financial documents are on record. The Child Care Management Plan at page 59 states that the parents will take the necessary leave to look after the child. 6.
The Home Study Report is positive and recommends the adoption. The other documents are in order.

I have also seen the scrutiny report presented by Mr O Hareendran, Scrutiny Officer of the Indian Council of Social Welfare which is on record.

In this view of the matter, I will allow the Petition. The Judge's Order is separately signed.

The Registry will get the Petition with all its annexures and all orders, including the signed Judge's Order, scanned. These digital copies are to be preserved. A soft copy may be given to the Advocate for the Petitioner free of cost on a pen drive provided by the Advocate for the Petitioner for the same. The Registry will ensure that the scan of the Judge's Order is a properly calibrated colour scan.
