The Petition is for leave under Clause XII of the Letters Patent. The proposed Suit is by an insurance company against a common carrier. The cause of action arose partly outside the jurisdiction of this Court while a material part of the cause of action arose within the jurisdiction of this Court. The Defendant has its registered office in Mumbai. With leave granted under Clause XII of the Letters Patent, this Court will have the necessary jurisdiction to entertain and try the suit.
