---- CORAM : K.R.SHRIRAM,J DATE : 28.4.2017 P.C.:- Mr.Shah appearing for the petitioner at the outset, raised a grievance that petitioner has not even been served copy of this chamber summons. Mr.Desai appearing for the applicants handed over copy of the chamber summons in Court and the matter was kept back for Mr.Shah to consider chamber summons and affidavit in support. Matter therefore, was kept back.

When it is called out again, Mr.Shah states that the petitioner will have no objection if the reliefs as sought in the chamber summons are granted since the relief is only to file 2 KJ

CST55.17-907 separate affidavits in support of the caveat as against consolidated affidavit filed.

In the circumstances, chamber summons allowed in terms of prayer clauses-(a) & (b) and accordingly disposed. Mr.Desai for the caveators/applicants states that the affidavits will be filed and copies also will be served on the petitioners by 2.5.2017.

Stand over to 13.6.2017 for issues.
