...Petitioner

Versus

Mantri Realty Limited

...Respondent

Mr Sahil Mahajan, for the Applicant and Original Respondent.

Mr Devendra Tiwari, i/b Siddharth Murarka, for the Petitioner. Mr Hussain, for the Official Liquidator.

Mr A Ramnath, Official Liquidator, with Mr P Raghunath, Dy Official Liquidator, present.

CORAM: G.S. PATEL, J DATED:

5th July 2018 PC:- 1.

The Provisional Liquidator has been appointed of Mantri Realty Limited ("MRL"). The present application is by one Ranjeet Rane, an erstwhile director of MRL. Mr Rane seeks directions for a limited purpose, to allow him to appear before the Income Tax Authorities in regard to proceedings by the Income Tax in respect of MRL.

911-CAL371-18.DOC 2.

Prayer clause (b) seeks an order that Mr Rane be allowed to engage consultants, both for accounting and legal advice, at his own cost. There can be no objection to that. In any case, the Provisional Liquidator will have to represent the company before the tax authorities in all proceedings, but to do so effectively will need to coordinate with the formal directors of MRL so that the orders are not passed on a default basis.

3.

I will allow the Company Application in terms of prayer clauses (b), (c) and (d) but will additionally direct the Provisional Liquidator to depute a representative from his office to attend the hearings before the tax authorities. I expect Mr Rane to furnish the Provisional Liquidator with all necessary documents and a copies of all filing that are made before the tax authorities. 4.

I am making it clear that Mr Rane is not to make any filing before the tax authorities without furnishing a copy to the Provisional Liquidator's office.

5.

The Company Application is disposed of in these terms with no order as to costs.
