CHAMBER SUMMONS NO.135 OF 2017 Chamber summons No.135 of 2017 taken out by plaintiffs to bring on record the legal heirs of deceased defendant no.2 is KJ

COMS7.06-26 pending. The chamber summons is taken out in view of a letter dated 30.8.2016 from Law Global-advocates for original defendant no.2 informing plaintiffs' advocate that defendant no.2 expired on 31.3.2014 and also mentioning therein the legal heirs who are to be brought on record together with their addresses. They have also annexed copy of the death certificate. This letter was addressed by Law Global to plaintiffs' advocate in compliance with order dated 20.8.2016.

I have considered affidavit in support. Chamber summons therefore, allowed in terms of prayer clauses-(a) and (b) and accordingly disposed.

Plaintiffs to amend the plaint and serve a copy of the amended plaint on all defendants including the newly added defendants 2(a), 2(b) and 2(c). Newly added defendants/defendants to file written statement/additional written statement within 4 weeks of receiving the amended plaint.

Suit be listed for directions on 3.11.2016.
