This petition is filed under Section 29A of the Arbitration and Conciliation Act,1996 seeking extension of the mandate of the arbitral tribunal for a period of three months.

This petition was filed on 17 July 2019. The extension which is sought, is from May,2019 as recorded by the learned sole Arbitrator Shri.Sitesh Mukherjee in the minutes of the meeting held on 10 April 2019. 4.

As the mandate of the arbitral tribunal had expired, the respondents had moved Civil Writ Petition no.9440 of 2019 before the High Court of Judicature at Rajasthan, Jaipur Bench, which came to be rejected by an order dated 3 March 2020 passed on the said petition by the Hon' ble the Chief Justice. The present proceedings had remained pending awaiting the decision on the said petition filed before the Rajasthan High Court.

Having perused the averments as made in the petition and considering the facts that the arbitral tribunal has already entered a reference and that the parties are before the arbitral tribunal, it would be in the interest of justice that the mandate of the arbitral tribunal is extended for a period of twelve months from today. Ordered accordingly.

The learned Sole Arbitrator shall make an endeavour to adjudicate the disputes as expeditiously as possible within the above extended period. All contentions of the parties on merits of the disputes are expressly kept open. 7.
