Ms.Pohonekar for the plaintiff seeks leave to withdraw the suit since the claim of the plaintiff has been settled pursuant to the Settlement Agreement dated 14th March 2017. Mr.Pratap appearing for defendant no.3 states that pursuant to an order dated 5th May 2017, the Official Liquidator of this Court has been appointed as Provisional Liquidator of the defendantcompany. Nobody is present for the Provisional Liquidator. Mr.Pratap states that in view of the Settlement Agreement referred above entered into Shraddha Talekar PS 1/2

44.coms.16.2004.doc between the plaintiff and defendant no.3, nothing survives in the suit and the suit has to be dismissed.

I have considered the Settlement Agreement dated dated 14th March 2017.

The suit accordingly stands dismissed.
