The Suit is settled. Consent Terms are tendered. These are signed by one Mr. Sisir Acharya, the 2nd Defendant, for himself and as the proprietor of the 1st Defendant, and by one Mr. Samir Pradhan, Head (Legal) of the Plaintiff. Mr. Pradhan is personally present in Court. Mr. Acharya's presence has been previously dispensed with.

Having seen the Consent Terms and being satisfied that they are not contrary to law and have been drawn by the parties on their own volition and reflect the parties' true intention, the Consent Terms are taken on record and marked "X" for identification.

The Suit is decreed in accordance with the Consent Terms. Drawn up decree dispensed with.

4.

Refund of court fees, if any, in accordance with the Rules. 5.

The Court Receiver has seized packets and the packaging material containing offending goods. The packets and packaging material are to be destroyed by the Defendants in the presence of the representatives of the Plaintiff within a period of four weeks from today.

The Court Receiver shall stand discharged without passing of accounts but on the Plaintiffs paying his costs, charges and expenses. This will be done within a period of four weeks from today.

In view of this, the Notice of Motion does not survive and is disposed of.
