This Leave Petition is filed to grant leave under clause XII. The proposed Suit is for declaration that the Plaintiff is entitled to 50% rightful share and interest in the Suit property set out in the Schedule of Properties at Exhibit-B to the plaint. Further prayer is sought for administration of the Suit properties, in accordance with law. One of the property which is Khar property is situated in Mumbai and the Defendant also resides in Mumbai. The other property mentioned in Exhibit-B is situated in Pune and for which under clause XII of the Letters Patent is being sought. Waghmare 1/2
