This is an application for appointing provisional liquidator on the assets of the respondent company namely Nimbus Communication Limited. It is submitted that in Company Petition No.387 of 2015 filed by the State Bank of Hyderabad this Court by an order dated 17.4.2017 has already admitted the said company petition and directed to appoint the provisional liquidator on the respondent company. The said order dated 17.4.2017 is produced across the bar and is taken on record. It is further submitted that the appeal preferred against the said order

2 /2CA-198-15-31 dated 17.4.2017 bearing Appeal Lodging No.176/2017 has been dismissed by the Division Bench by its order dated 5.5.2017. In view thereof the order dated 17.4.2017 holds the field as of today.

In view of the facts mentioned herein above the present application for appointment of Provisional liquidator is misconceived and does not survive. 3. Application is accordingly disposed off.
