It is seen that applicant has served the respondent on 06.01.2020 and acknowledgment thereof has been placed on record by way of an afdavit fled on 17.01.2020. 4.

After hearing learned counsel for the applicant and on due consideration, service of notice on the respondent is accepted.

We have perused the averments made in the Notice of Motion and we are of the view that applicant has explained the delay in fling the related appeal.

Consequently, we condone the delay of 17 days in fling the related appeal.
