---- CORAM : K.R.SHRIRAM,J DATE : 12th October, 2015 P.C.:- At the outset, the counsel for the plaintiff states that the cause list for the day incorrectly shows Notice of Motion No.2928 of 2009 whereas it should be Notice of Motion No.2958 of 2009. The office to make a note of this and accordingly correct the records. The counsel for the plaintiff further states that defendant no.1 is in liquidation and leave under Section 446 of the Companies Act is required to be taken from the Company Court. The counsel, therefore, seeks leave to withdraw the present notice of motion with liberty to take out fresh notice of motion after obtaining leave from the

Company Court.

Therefore, the notice of motion is allowed to be withdrawn with liberty as prayed.
