Learned advocate appearing on behalf of the Plaintiff submitted that in view of the reply filed by the Defendant, he now intends to amend the plaint.

In these circumstances, he prays that he may be permitted to withdraw the Summons for Judgment, to amend the plaint and thereafter file a fresh Summons for Judgment. Considering these facts, the Summons for Judgment Pg 1 of 2

18.sj.63.2017.doc is dismissed as withdrawn with liberty to the Plaintiff to file fresh Summons for Judgment after he takes out a proper application for amendment of the plaint.
