This is third time that the Petitioner is absent. Notice was previously directed to be issued to the Petitioner. This was done under the Registry's letter dated 10th June 2016. Mr. Tadke is present at the request of the Court. He reiterates that he returned the papers several years ago in 2012 but he has no instructions. Certainly he cannot be held responsible for the consequences that must now follow.

The Petition is dismissed. However, with liberty to the Petitioner's to apply for restoration of the Petition or to file a fresh Petition for the same reliefs.
