Mr.Kantilal H. Kanojia for Respondent no.5.

CORAM : S.C.DHARMADHIKARI AND B.P.COLABAWALLA, JJ.

DATE : 26 November 2015 PC :

1.

Though this Court suo motu treated the present proceedings as a Writ Petition, on a complete perusal of the record, we find that the Petitioner Ms.Meena Arun Nawalkar is claiming entitlement and particularly with regard to her maintenance in her old age, on the basis of right, title and interest in certain properties, movable and immovable. 2.

The Petitioner, therefore, will have to file independent proceedings and implead all those persons who have been specifically named by her in her written submissions.

2 of 2 SMWP.1.2015 These written submissions and other documents filed by her have been carefully perused by us. We are of the opinion that this petition cannot be pursued as suo motu writ petition any longer bearing in mind the factual controversy and the claim of the Petitioner. We grant her liberty to file appropriate proceedings in order to seek proper reliefs. With this liberty, we dispose of this suo motu writ petition.
