Considering the fact that there is an alternative remedy, namely, appeal under Section 35 to the Additional Collector, learned Counsel for the Petitioner seeks leave to withdraw the petition keeping all rights and contentions open.

The petition is dismissed as withdrawn. Liberty to the Petitioner to raise all the grounds of challenge forming part of the present petition before the appellate forum under Section 35 of Maharashtra Slum Areas (Improvement, Clearance and Redevelopment) Act, 1971. In the meantime, for a period of one week from today, the authority shall not take any steps for forcible eviction or demolition of the Petitioner's structure. (S.C. Gupte, J.)
