The Petitioners in the above mentioned Petitions challenge the orders passed on various dates in February 2014 by the Deputy Chief Officer of the Mumbai Repairs and Reconstruction Board cancelling the allotment of tenaments made to the Petitioners pursuant to the lottery which was held for the said purpose. Against such orders an Appeal lies under Regulation 18(4) of the MHAD (Establishment, Management, Sell, Transfer and Exchange of Tenament) Regulations, to the Chief Executive Officer of the MHADA. The Learned Counsel Mr. Shinde appearing for the Petitioners in view of the said remedy available seeks withdrawal of the above Petitions with liberty to invoke the said remedy. The above Petitions are accordingly allowed to the withdrawn with liberty as prayed for.

Needless to state that the contentions of the parties are kept open for being urged before the Appellate Authority. Needless to state that the Appellate Authority would decide the Appeals on its own merits and in accordance with law.
