The Company Petition is taken out by the Director of the Petitioner Company under section 560 (6) of the Companies Act, 1956 (the Act) seeking necessary directions against the Registrar of Companies for restoration of the name of the Petitioner i.e. Star Cruises (India) Private Limited to the register of Companies, which was struck off by a notification published in Part III - Section 1 of the Gazette Notification issued by Government of India for the period May 28 - June 3, 2011. 2.

Considering the averments made in the Petition, I am inclined to allow this Petition in terms of prayer Clause (a) on the following terms and conditions :

Nitin 962-CP-691-2014 (i) The Company Petition of the Petitioner Company stands allowed, subject to the following directions :

(a) The Directors of the Company will obtain Director's identification numbers and file all statutory returns including pending statutory returns and compliances electronically under the various provisions of the Companies Act, with the Registrar of Companies within a period of 12 weeks from the date of this order ;

(b) The Petitioner Company shall comply with Sections 266A to 266G, 159 to 162, 166, 210 and 220 of the Companies Act and to make an appropriate application under Section 621A of the Companies Act, for compounding the offences, if any.

(c) The Petitioner Company to pay costs of Rs. 10,000/- to the Respondent.
